1. Acceptance of Terms
By accessing or using LuluTag ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
LuluTag provides a platform to register items, generate QR-code tags linking to those items, and allow finders to contact owners via the Service (e.g. messages and email). The Service does not arrange, supervise, or guarantee in-person meetings or returns of items.
3. Eligibility
You must be at least 13 years of age (or the minimum age in your jurisdiction) and able to form a binding agreement to use the Service.
4. Account and Use
You are responsible for keeping your account credentials secure and for all activity under your account. You will use the Service only for lawful purposes and in line with these Terms and any applicable laws.
5. Your Content and Items
You retain ownership of content and item information you provide. By using the Service, you grant LuluTag a limited license to use, store, and display that information to operate the Service (e.g. showing item details to finders and sending messages/emails). You represent that you have the right to post such content and that it does not infringe others' rights.
6. Finder–Owner Communication
The Service may allow finders to send messages or contact owners. LuluTag is not responsible for the content of those communications or for any in-person meetings or exchanges. You use any contact or meeting features at your own risk.
7. Disclaimers
The Service is provided "as is" and "as available." LuluTag disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. LuluTag does not guarantee that the Service will be uninterrupted, secure, or error-free. LuluTag is not responsible for in-person exchanges, returns of items, or any harm arising from use of the Service or from interactions between users.
8. Limitation of Liability
To the fullest extent permitted by law, LuluTag and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use or inability to use the Service or from any conduct of other users. In no event shall LuluTag's total liability exceed the amount you paid to LuluTag in the twelve (12) months before the claim (or one hundred US dollars if greater).
9. Indemnification
You agree to indemnify and hold harmless LuluTag and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or any law.
10. Changes
LuluTag may change these Terms from time to time. We will post the updated Terms and update the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
11. Termination
LuluTag may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification) will survive termination.
12. General
These Terms are the entire agreement between you and LuluTag regarding the Service. If any part is held unenforceable, the rest remains in effect. LuluTag's failure to enforce any right does not waive that right. These Terms are governed by the laws of the United States, without regard to conflict of laws.
